Delhi High Court recognises lunch break accident as employment injury

2026-08-12 · Delhi High Court
The Delhi High Court has ruled that an accident occurring during an employee's lunch break at the workplace qualifies as an employment-related injury under the Employees' Compensation Act, 1923. In this specific case, the Court directed an insurance company to pay Rs 7.86 lakh in compensation along with 12 per cent annual interest to a construction worker who suffered permanent disability from an accident that occurred 16 years prior. The judgment establishes that the employer's premises and working hours envelope extend to cover breaks taken on-site, broadening the scope of what constitutes a compensable workplace injury. This ruling has significant implications for employers' workers' compensation liability and insurance obligations, as lunch breaks spent within workplace boundaries are now recognized as falling under employment-related injury provisions. Employers must ensure adequate safety measures during meal breaks on premises and review their workers' compensation insurance policies to account for this expanded liability. Insurance providers will face increased claims under the Employees' Compensation Act, 1923 for incidents previously considered outside employment coverage. Businesses should strengthen workplace safety protocols during break times and recalibrate risk assessments accordingly.
