RBI Issues Commercial Bank Loan Recovery Conduct Framework Effective January 2027

The RBI issued the Fourth Amendment Directions, 2026 on 07 August 2026, introducing a comprehensive framework governing commercial bank loan recovery operations, recovery agent conduct, borrower safeguards, and device-locking prohibitions effective from 1 January 2027. The amendment prescribes detailed rules for how commercial banks and their appointed recovery agents must conduct collection activities, including permissible communication methods, frequency limits, and timing restrictions on contact with borrowers. The framework establishes explicit borrower protection measures prohibiting recovery agents from locking or disabling borrower devices (mobile phones, computers) during debt collection, a practice previously used coercively in field recovery. The directions mandate that banks implement grievance redressal mechanisms for borrower complaints against recovery agents and establish oversight committees to monitor compliance with conduct norms. Commercial banks must revise recovery agent agreements, train personnel on the new conduct requirements, and implement technology controls to prevent device-locking across their recovery networks. The six-month implementation window allows banks to audit existing recovery practices, update vendor contracts, and establish monitoring systems. This represents a significant regulatory shift toward borrower-centric debt collection standards, reducing predatory recovery practices while maintaining legitimate collection effectiveness.
